These terms govern your use of this website and the engagement of arboricultural consulting services from Assurance Trees Pty Ltd (ABN 87 158 399 350). By using this website or engaging us to provide services, you agree to these terms.

Website use

The content on this website is provided for general information about our services and is not, in itself, professional arboricultural advice. Site-specific recommendations require a written, signed report based on an inspection by an appropriately qualified arborist for your particular site. Do not rely on website content alone to make tree-management decisions on a specific property.

Engagement of services

Engagement of arboricultural consulting services is a separate matter from website use. A formal engagement is established only when:

  • We have issued a written scope and fee proposal for the work you’ve requested
  • You have accepted that proposal in writing (email or signed document)
  • Any required deposit has been received where applicable

The terms applying to a specific engagement are those set out in the engagement-specific proposal and accompanying terms of engagement, which take precedence over these general website terms for matters relating to that engagement.

Professional standards

All arboricultural consulting work we deliver is performed in accordance with the relevant Australian Standards, including:

  • AS 4970 (2025) — Protection of Trees on Development Sites
  • AS 4373 — Pruning of Amenity Trees
  • ISA TRAQ methodology — for Tree Risk Assessments
  • Burnley Method — for Tree Valuation work

Aaron Bath, Director, holds AQF Level 5 Diploma of Arboriculture (Consulting Arborist), AQF Level 3 Certificate III in Arboriculture, ISA TRAQ certification, and is a Licensed NSW Builder.

Insurance

Assurance Trees Pty Ltd carries $20 million Public Liability and $5 million Professional Indemnity insurance cover. Certificates of currency are available on request.

Reports, deliverables and intellectual property

Reports and other deliverables we issue are prepared for the specific client and the specific purpose set out in the engagement scope. Unauthorised reproduction, distribution to third parties beyond the agreed report recipients, or reliance by parties other than the engaging client for purposes other than the original engagement is not permitted without our written consent.

Copyright in reports, drawings, GIS data layers, photographs and other materials we produce remains with Assurance Trees Pty Ltd. The engaging client receives a non-exclusive licence to use the deliverable for the purpose for which it was prepared.

Limitations

Inspections and reports describe the condition of trees and the relevant site at the time of inspection. Tree health, structural condition and the surrounding site context can change with time, weather events, construction works, or third-party actions. Recommendations carry an implicit time horizon — typically twelve months — beyond which a re-inspection is generally appropriate.

To the extent permitted by law, our liability for any matter arising out of an engagement is limited to the fees paid for that specific engagement. Nothing in these terms excludes any guarantees, rights or remedies that cannot lawfully be excluded under Australian Consumer Law.

Cancellation and variation

If you cancel an engagement after we have commenced work but before delivery, you will be invoiced for the work completed to that point. Variations to scope after acceptance are subject to a written variation agreement and may attract additional fees.

Governing law

These terms are governed by the laws of New South Wales, Australia. Any dispute relating to these terms or to a specific engagement will be subject to the exclusive jurisdiction of the NSW courts.
